TERMS & CONDITIONS NORTH CHANNEL HEATING & AIR CONDITIONING INC. (HEREIN CALLED THE COMPANY) RIGHT TO CANCEL: The Company reserves the right to immediately terminate this Agreement in the event (i) The Client fails to fulfill the payment terms contained on the face side of this Agreement or (ii) the equipment in the opinion of The Company does not meet safe operating standards and The Client is not willing to rectify the unsafe conditions. CLIENT'S RIGHT TO CANCEL: This agreement will renew annually, unless written notice is given to The Company within sixty (60) days prior to the anniversary date. AGREEMENT VALIDITY: Before this agreement can be valid, an initial maintenance and inspection must be performed by a technician from The Company, after which the equipment MUST be brought up to The Company’s standards at the expense of The Client. EQUIPMENT: The annual investment to be paid by The Client under this agreement is based upon the maintenance of the Equipment and Accessories listed on the face side of this Agreement as a complete package. In the event additional equipment is added, the same would be covered with an increase of the annual charge. WARRANTIES & LIMITATIONS ON WARRANTIES: The Company warrants that all work performed hereunder will be completed in a professional manner and said work shall be free from defects in workmanship for a period of twelve (12) months from the date said work was performed. The Company's obligations for defective products and/or workmanship or any damage caused thereby, and the Buyer's exclusive remedy, shall be limited to the replacement of any defective parts or workmanship and shall be conditioned upon The Company receiving actual written notice of said defects within the applicable warranty period(s). THE FORGOING WARRANTIES ARE EXCLUSIVE AND IN LIEU OF ALL OTHER EXPRESS OR IMPLIED WARRANTIES AND FITNESS FOR A PARTICULAR PURPOSE. THE COMPANY SHALL NOT BE SUBJECT TO AND DISCLAIMS ALL CONSEQUENTIAL, INCIDENTAL AND CONTINGENT DAMAGES WHATSOEVER. TRANSFERABILITY: This Agreement is transferable to the subsequent owner of the home in which the Equipment and Accessories are located for a cost of $50, provided The Company receives written notice of the sale of the property within sixty (60) days prior to the transfer. At this time, The Company reserves the right to require an additional Maintenance & Inspection at The Client’s expense before the Agreement can be transferred. In the event that the new owner refuses to assume this agreement, balance is due and payable upon closing. ENTIRE AGREEMENT: This agreement sets forth the entire Agreement between the parties and supersedes all other agreements either written or oral concerning the subject of the agreement. THIS AGREEMENT DOES NOT APPLY TO ANY REPAIRING, SERVICING, REPLACEMENT, OR MAINTENANCE OF PARTS AND/OR ACCESSORIES CONNECTED TO THE APPLIANCE, WITHOUT LIMITING THE GENERALITY OF THE FORGOING. THIS AGREEMENT EXCLUDES THE FOLLOWING (A-D): A.Any malfunction that is directly attributable to, in whole or in part, by the action of water, fire, lightning, vermin or the willful act or gross negligence of any person. B.Changes or alterations required by government regulations, calls for fuse replacement, noises, smells not related to the equipment covered, switches, breakers, thermostats, aqua stats, valves turned down or off, humidifiers and electronic air cleaners. C.The equipment, the distribution ducts system, zone controls or baffles and condensate pumps. D.For hot water heating, radiators, cushion tanks, water piping, circulation pumps or their components, condensate tanks, zone controls, automatic feed and relief valves, de-liming, draining/filling un-valved boiler systems, de-liming of water boilers, draining/filling un-valved expansion tanks and bleeding of radiators. IMPORTANT SAFETY INFORMATION 1.Be alert for the odour of propane when around a gas appliance or container. 2.If you smell gas, do not try to light the appliance, call North Channel Heating & Air Conditioning or your local authorities. 3.If you smell gas near your tank or cylinder, call North Channel Heating & Air Conditioning or your local authorities. 4.Read and follow the operating and lighting instructions and warning labels provided by the appliance manufacturer. 5.If your appliance has a pilot light, the pilot has a safety device. If you have trouble keeping it lit, the device is warning you about a problem, call North Channel Heating & Air Conditioning for technical assistance. 6.Never force any appliance control. If you cannot operate the knobs, switches or buttons by hand, call North Channel Heating & Air Conditioning. Never tamper with the controls. 7.Use only listed propane appliances. Look for the seal from a nationally recognized independent testing laboratory. 8.Use propane barbecues outdoors only. Use or store propane cylinders outdoors only. 9.Keep combustibles, such as curtains, paper, cleaning fluids, etc. away from energy source, including gas and electric appliances where they may cause a fire. 10.If you buy a used appliance, have it inspected and installed by a qualified propane installer.
